1. Acceptance of Terms

By downloading, installing, or using DailyGlowUp (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Age Requirement

You must be at least 13 years old to use DailyGlowUp. By using the App, you represent and warrant that you are at least 13 years of age. If you are under 18, you confirm that you have obtained permission from a parent or legal guardian to use the App.

3. Description of Service

DailyGlowUp is a skincare habit tracking application that uses AI face scanning to analyze skin metrics (Hydration, Clarity, Texture, Radiance), generate personalized skincare routines, and track your progress over time. All data is stored locally on your device.

4. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial use. This license is governed by the Apple Licensed Application End User License Agreement (LAEULA) and any usage rules set forth in the Apple App Store Terms of Service.

5. User Responsibilities

You agree to:

  • Provide accurate information when using the App
  • Use the App for personal, non-commercial purposes only
  • Not misuse or attempt to reverse-engineer our AI systems
  • Not upload inappropriate, harmful, or illegal content through photo features
  • Not attempt to gain unauthorized access to any portion of the App
  • Not use the App in any manner that could damage, disable, or impair the App
  • Comply with all applicable laws and regulations

6. Medical Disclaimer

DailyGlowUp is not a medical device and does not provide medical advice, diagnosis, or treatment. The AI-generated skin scores and routine recommendations are for informational and educational purposes only and should not be considered a substitute for professional medical advice. Always consult a dermatologist or qualified healthcare professional for any skin concerns, medical conditions, or before starting any new skincare routine. We make no representations or warranties regarding the accuracy of skin analysis results.

7. Product Information and Recommendations

DailyGlowUp provides general information about skincare products based on common ingredients and dermatological practices.

Important Disclaimers:

  • Product recommendations are educational suggestions only, not medical advice
  • We do not manufacture, sell, distribute, or profit from recommended products
  • Product information is provided for reference purposes only
  • Products listed are commercially available items - we make no claims about their safety or efficacy for your specific skin concerns
  • Individual results may vary - what works for one person may not work for another
  • Always perform a patch test before using new products
  • Consult a licensed dermatologist or healthcare provider before starting any new skincare regimen
  • We are not responsible for allergic reactions, skin irritation, or other adverse effects from products you choose to use
  • Product availability, formulations, and ingredients may change - always verify current product information before purchasing

By using DailyGlowUp's product database and recommendations, you acknowledge these are general suggestions and agree to make your own informed decisions about skincare products.

8. Intellectual Property

All content, features, functionality, and intellectual property rights in the App, including but not limited to software, code, algorithms, design, graphics, text, and trademarks, are owned by DailyGlowUp or our licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of photos you upload to the App.

9. Warranty Disclaimer

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DAILYGLOWUP, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless DailyGlowUp and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your use of the App caused damage to a third party.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, with or without notice, effective immediately, including if we believe you have violated these Terms. You may discontinue use of the App at any time by deleting it from your device. Upon termination, all licenses and rights granted to you in these Terms will immediately cease. The provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Data Storage and Privacy

All user data, including photos and skin analysis results, is stored locally on your device. We do not maintain copies of your data on our servers except for temporary processing during AI analysis. Please refer to our Privacy Policy for detailed information about data collection and use.

14. Third-Party Services

The App uses Google Gemini API for AI-powered skin analysis. Your use of this functionality is subject to Google's terms and policies. We are not responsible for the practices of any third-party services integrated with the App.

We may use third-party analytics and data-tracking services to improve app performance, fix issues, and understand usage patterns. Any such tracking complies with Apple's App Store Terms of Service and App Tracking Transparency requirements. Where required, we will request your consent before tracking that is used for advertising or shared with data brokers. Details of our analytics practices are set forth in our Privacy Policy.

15. Apple-Specific Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

  • These Terms are between you and DailyGlowUp only, not with Apple, and Apple is not responsible for the App or its content
  • The license granted to you is limited to a non-transferable license to use the App on an Apple-branded product running iOS
  • Apple has no obligation to provide maintenance or support services for the App
  • Apple is not responsible for any product warranties, whether express or implied by law
  • Apple is not responsible for addressing any claims by you or any third party relating to the App
  • In the event of any third-party claim that the App infringes intellectual property rights, Apple will not be responsible for investigation, defense, settlement, or discharge of such claim
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you
  • You represent that: (a) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in California, and you hereby irrevocably consent to personal jurisdiction and venue therein.

17. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the “Last updated” date at the top of these Terms. Your continued use of the App after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DailyGlowUp regarding the use of the App and supersede all prior agreements and understandings.
